Terms and conditions of purchase

1) PRIOR INFORMATION.
Swissbags informs that the procedures for purchasing goods and/or obtaining the services offered are those described in these general terms and conditions, as well as any other specific procedures indicated on screen during the browsing and purchasing process, so that the User declares that he/she is aware of and accepts these procedures as necessary to access the products and services offered on this website.
By making use of this website and placing orders through it, the user undertakes to:

  1. Use this website solely and exclusively to place legally valid orders.
  2. Do not place any false or fraudulent orders. If it could reasonably be considered that such an order has been placed, Swissbags is authorised to cancel it and inform the competent authorities.
  3. To provide us with your email address, postal address and/or other contact details truthfully and accurately for the purpose of processing orders, and to keep these details up to date. If you do not provide us with all the information we require, we will not be able to process your order.
  4. By placing an order through this website, you declare that you are over 18 years of age and have the legal capacity to enter into a contract.

2. PLACING ORDERS

– The service is provided by Swissbags.

– In order to access the services offered through the website, the User can access through their account (if they have previously registered), or place their order “without registering”. To access as a registered user, you must enter your e-mail address and the password provided in the registration process. The User Name and the Password are identifiers and enabling elements to access the services and are personal and non-transferable.

-To proceed with the purchase of the different products offered, the User must follow all the indications and instructions given on each screen, and provide the data required for the management of the order, determining on each form the data that are obligatory for the purchase process.

-Once the User has selected all the desired purchase products on the website, he/she must select the “Finish” option, and the products included in the purchase will appear on the corresponding screen with the final price (VAT and delivery costs included), together with the offers applicable to the order, at which point the user selects the offer he/she considers appropriate and enters the discount codes, if any.

– All orders are subject to the availability of the products in the establishment. If there are difficulties in the supply or if there are no items in stock, the establishment will contact the user to inform him/her, offer an alternative product and/or refund the amount that he/she may have paid.

-Confirmation of the order: Once the purchase process has been completed, the order confirmation option appears, in which the products purchased will be listed, and the user will be responsible for reviewing and confirming the products, prices and offers selected, if applicable. Once the order has been confirmed and the order has been received, Swissbags will send the customer a delivery note by e-mail confirming the purchase.

 

3. WITHDRAWAL

Swissbags informs the User that it is not obliged to send the consumer a withdrawal document in order to revoke the contracting of the service offered through our website within the legal deadlines, as it falls within the exceptions established in Articles 102 and 103 of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, by virtue of which it is established that there is no right of withdrawal in contracts for the supply of goods made according to the consumer’s specifications or clearly personalised, or which, by their nature, cannot be returned or may deteriorate or expire rapidly.

 

4. PRICES AND DELIVERY TIMES

At the time of purchase, the final price per product will be shown in euros, including VAT. Orders whose delivery destination is the Canary Islands will be exempt from VAT and will be subject to the Canary Islands General Indirect Tax (IGIC).
Some of the offers and promotions that appear on the website are exclusive to orders placed through the website, and are not valid for orders placed by telephone or in the establishment itself.

The cost of shipping to Spain is 5,79 €.

 

5) PAYMENTS

On the screen corresponding to the payment of the order, the different means of payment available in the establishment of reference will appear, and you can choose the one that is most convenient for you.
The different means of payment available at each establishment are as follows:
– Credit and debit card.
– Bizum
Credit cards will be subject to checks and authorisations by the issuing bank, but if the issuing bank does not authorise payment, we will not be liable for any delay or non-delivery and we cannot enter into any contract with the User. By authorising payment with the card provided you are confirming that you are the cardholder.
The website uses industry standard information security techniques, such as firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorised access to data. To achieve these purposes, the user/customer agrees that the provider obtains data for the purpose of authentication of access controls.
Refund or return policy for card payments:

In cases where a refund or credit to the user of payments made by card is proven to be appropriate, Swissbags will endeavour to make the corresponding refund on account within 10 working days.

 

6) DELIVERY TIMES

The delivery time estimated by Swissbags is 48-72 hours after receipt of payment of the order. Delays in delivery due to transport problems beyond the company’s control will not result in the cancellation of the order or any compensation.

 

7) COMPLAINTS.

Swissbags has complaint forms available to its customers in the establishments of reference. We recommend that users file their complaint with the establishment responsible for the actual provision of the service.
